But a BMW probably won't be any more reliable in my experience nor the dealer network any better

AdeC, I hope you get things sorted without too much expense. As said, a specialist is the way to go for a rebuild. To be fair, I don't think I would have even bothered contacting the manufacturer without full dealer service history and out of warranty. You'd probably struggle to get any more than a % of the bill paid even if you had the full history. Even on lesser repairs with fsh i've always found manufacturers a battle.
Let us know how you get on

I was going to say forget about any warranty. Take legal advice to establish if you have any redress under the Sale of Goods Act, etc.

Not likely. Car is well out of warranty and he has admitted to driving it when he knew it was at fault

I can see where the bit about driving through the warnings might be a problem, but the warranty status is irrelevant.

I now have the car back, AV Performance did the bizz and now I am back on the road. OK I am seriously out of pocket and my next bank robbery will be a good un, but at least I no longer have to drive the wifes VW Beetle convertible, with orange flower in the vase, I was getting used to the lack of power and the "gay" hand signs from my mate as I drove away from the ballet classes...but now I feel normal again, even though I have not taken the car above 70mph yet, let the girl run in for a 1000 miles I haev been told. I have even started using that special V - Power high octane petrol. The power is there though, even without giving it full throttle she pulls away perfectly through all 6 gears , infact it feel better and more powerfull than when I bought it. Very impressed with AV Performance, kept me updated throughout, sent pictures of the damage and the new engine, recomend them without a shadow of doubt, thanks Ben.

Only issue now is my power steering pump has broke ahaha I give up, fckign Audi;s. Anyone near Warrington on Cheshire got a power steering pump they can sort me out with please, the noise the car now makes is a constant whistle noise once its warmed up, if the car is in acceleration there is no noise, soon as I take foot of the gas its screaming its t1tts off.
