330dcoupe Posted June 18, 2007 Report Share Posted June 18, 2007 I was recently issued a parking ticket by Ealing parking services for parking on a single yellow line in a road just off the main road in Southall. No-where on that road was there an indication of the actual parking hours. Me and my friends scanned the whole road and found nothing. Two local police officers also said I was unjustifiably issued the ticket and that they would appeal against the decision, if they were me. Now, I don't want to go into the reason why I (and many others) got\get parking tickets in this part of the country..and it has nowt to do with parking illegally! I took some pictures of the actual road and where my car was parked and sent the notice back with a big letter. They have since responded, and claim that they were right in issuing the penalty notice. (surprise!)They claim that that particular road was a Controlled Parking Zone which has restricted parking hours of 10:00-20:00(Mon-Sat) and 14:00-20:00 (sun) and therefore has no reason to be sign posted with hours. Do you think I should reply back and put a case up for the fact that I'm not a local and was un-aware of the parking zone and it's hours? or shall i just pay the thieving hell bound mo-fo's? Mook Posted June 18, 2007 Report Share Posted June 18, 2007 Ignorance of the area won't stand you in good stead, unfortunately. By writing to them, you've acknowledged that it was you, so you can't get out of it that way. To defer paying for a month or so, I would suggest you write back to them and ask them to be lenient. Whoever gets your letter will check it against a list they have of reasons why people don't have to pay, and if your reason isn't on there, then they'll just send you a letter reminding you that you need to pay. 330dcoupe Posted June 19, 2007 Author Report Share Posted June 19, 2007 I will be speaking to a few friends of mine, who hold position in the old law industry and see what they say. being ignorant and totally oblivious are two totally different things, I was definitely of the former category. The fact that I scanned the whole of that road for any clues as to what the parking hours were would also suggest that I didn't just park there and hope for the best. I have another week to pay the fine, and in the meantime will seek some advice. jettadeluxe Posted June 19, 2007 Report Share Posted June 19, 2007 Its illegal to park on double yellow lines, but there's no warning notice anywhere there are lines, you are expected to know that its illegal. The same would apply here, single yellows are obviously subject to parking restrictions, the onus is on the driver to confirm these before parking there. If it was a random unmarked piece of road, yes, but single yellow lines are sufficient to say 'there's restrictions on this road - only park here if you know you are adhering to them.'
