New Scirocco - Anyone want it?

Hi All,

Ordered a new Scirocco 2 months ago having placed a deposit to reserve a production slot in March.... changed my mind though and since ordered a new MKII TT.

Car ordered........

Candy White

Truffle Leather

Panoramic Roof

DAB touch screen head unit

Dynaudio premium sound

Anyone know if it's possible to sell a car before the stealer delivers it? - I have no wish to buy it then sell it (obviously going down as an owner on the V5 history etc)?....

Also anyone interested in buying the car? - not looking for a profit, just my 500 notes back for the deposit.

Anyone have experience of this?

You can legitimately ask for your deposit back from the dealer +++

I'm sure you are right (aren't you always :uhoh:) but could you explain how and why you can ?

Surely a deposit is a commitment to a supplier to arrange delivery of the item deposited for, and as such provided the dealer makes such arrangements then the deposit cannot be returned should the purchaser change their mind.

Property law is quite clear that on exchange should a sale not complete then the purchasers deposit is lost, why is a car different?

Must admit Mook, I thought there'd be next to no chance of getting the deposit back - yes if I'd only reserved a production slot, but the car has been ordered/spec'd now, so I was under the impression that my deposit was non-refundable now?

Would really appreciate it if anyone could confirm the position?

No takers for the car then?...

What is the point of these deposits?

Most people get their money back so bother taking the cash?

Also since in cases like the Scirocco, no one has actually seen one when the deposit's placed, you can't know for sure that you want it until you've seen it. Don't distance selling rules come into play or something like it?

At the same time, if you pay a desposit and simply change your mind, should you get it back? It's hardly the manufacturers fault. Perhaps they deserve the cash so they can advertise it/hold it as stock etc.

Why not just take delivery and sell on quickly. There has to be a chance of a bit of profit as the waiting lists will grow once the cars are released if they are as well liked as they seem to be. Can't imagine the premium will be huge but you may get some rich old boy needing a Scirocco for the pampered wife or 18 year old daughter who just can't wait.

I realise its a new model but is VW saying seven months in advance of the build month (March 2009) you or another potential buyer for your build slot can't alter the spec already ??

therein lies my problem... i placed my initial deposit in march but i've since ordered the car in july. i think given the fact that it's spec'd now, the dealer isn't going to want to part with his 500 notes. have no interest in buying it then selling straight away - far too much hassle!

could either make up a sob story and hope that the dealer is compassionate (you know, boo hoo i've lost my job etc) or try and sell the car before it arrives!:confused:

I doubt you’ll find any takers for your slot as the Cars already been speced I ordered less than two weeks ago only rang 3 Dealers and 2 of them were able to offer me a September Delivery to my own Specification (ordered White DSG with Anthracite Leather and even managed a £100 Discount)

So I would be inclined to tell the Dealer asap that you need to cancel (worth the slight sob tale) Depended on the terms and conditions of your contract I doubt he is legally bound to repay your Deposit back but as good PR Main Dealers usually do if they can sell the Vehicle on without much hassle (which should be easy in your case) So if the Dealer knows you no longer require your car when he gets an enquiry he can then offer them yours

Not worth taking delivery and trying to sell as I think in the present economic climate you’ll lose more than your £500 Deposit
