Another neighbour problem

Moved to a new apartment a couple of months ago, the top floor with a balcony on each side - all very nice. Problem is the people below us, a 30 something couple with a 8 year old son, smoke. Now they don't just have occasional smoke, they are probably on a packet a day each, if not more.

Normally I wouldn't care what anyone does in the privacy of their home but they are smoking to the point where the smoke finds it's way into our apartment via the internal ventilation! Or, worse, when smoking on the balcony (every 20 minutes or so it seems) the smoke will rise and come into the apartment via an open window. It might sound petty but for a non-smoker it really is bothersome. You can even smell the foul stench of them in the lift after they been in it.

I'm not quite sure what to do; I s'pose they have a right to smoke on their balcony or in their home... Are there any laws on secondary smoke?

I'd find that really annoying, too. Cigarette smoke is something I find very unpleasant. I really don't think I'll ever understand why smokers smoke.

I'm not sure there's much you can do, unless there's anything in your tenancy agreements or leases.

In the UK building vents between floors shouldn't be common. The logic is that should some other flat in the building gas posion, burn or have killer CO2 levels the gas should NOT be able to move between flats. So if the smoke is getting in to your flat via a vent I'd have a word with the landlord.

As for balcony, they can do anything they want- Sad as it might seem the cure for that would be a fan on your balcony that you can use when the balcony door is opened to blow any rising bad smells away.

As for the lift, maybe stick a car smelly thing as an odour eater might help.

My experience of heavy smokers is that they (like peeps with BO or over use of garlic) have absolutely no idea that they smell.
