Jessica was pretty well unknown other than as the TG theme tune. The Chain, on the other hand, was released by a well-known group, has an independent standing, and was used to introduce something external and well-known that the BBC was simply covering. In the end, it comes down to what people think when you play them the piece (as used by the people you're suing). With The Chain, it could be: - Fleetwood Mac - there's an F1 race about to be shown - We're watching the BBC who are about to screen an F1 race I'd suggest one of the first two is the most likely, which would be bad news for the BBC.
