bazza_g
...and the fine/points land on your doorstep in the UK A friend of the family was caught twice by speed cameras on the great ocean road in his hire car and now the paperwork (fine+points) have arrived in the post - the question is should he respond or just ignore it? What are they likely to do if you ignore it?
BURTON
Did you have to sign for the letter!?
shao_khan
If he ignores it then it will be nothing more than an arrest warrent the next time he steps into Aus......Currently I believe that is the only action they can take.
Rachel
The "penalty" for non-payment should be in the fine print. Any arrest warrant (if such is the case) would be only for that state (probably Victoria in this case)... You do not want to be detained down here if you can avoid it - it is pretty unpleasant according to my Police mates.
bazza_g
cheers for the advice, I'll find out more and see if I can get a look at the paperwork. If he just cough's up the payment what are the chances the points will find their way back to the UK license?
Rachel
Points - I'd say none... But you can never be sure nowadays given we are all part of the "coalition of the willing".
Dave
My take would be this: The hire car company has received the notice, they check the details, think.. oh sh1t!!, it's in the uk, so they've done what they had to and that's to inform the authorites of who was driving. I would say ingore it. They have no legal rights in the uk to prosecute and there are no two way agreements (I have an aussie mate who drive in the UK on an Aussie licence and had been caught at least half a dozen times and let off). Just bin it.
Atomic
Brother-in-law was cauht for speeding in Aus while driving on a GB passport. He was fined but his licence was unaffected. That was until he applied for an Aus licence and it arrived with 3 points already on it... So imo if you dont pay you're likely to end up with a state warrant which would take effect next time your in aus. or... If you do pay you would end with points on a potential licence. You dont mention how fast over the limit he was done for. Aus system is quite straight forward. For every 15kph over the limit you recieve 3 points, upto a max of 12 point. However i'm told its very worthwhile contesting based on lack of local knowledge etc. as it's easier to get the summons squashed. Albeit 2 might be a bit much...
